1. We reserve the right to change these terms and conditions at any time. It is your responsibility to read them each time you use this website and therefore be bound by our terms and conditions.
   
2. All orders placed on this website shall be subject to acceptance in accordance with these terms and conditions.
   
3. Acceptance and the completion of the contract between yourselves and SMH Cars Limited will take place on despatch to you of the goods in question, unless notified by us that we do not accept your order or you have cancelled it.

Delivery

1. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors. SMH Cars Limited shall be under no liability for any delay or failure to deliver the products within estimated timescales.
   Any delivery date quoted is an anticipated date only and cannot be guaranteed by the company. However the company shall use all reasonable endeavours to have the goods ready for delivery by the anticipated date. Should the company be unable to deliver the goods by the anticipated date the customer shall not be entitled to repudiate, terminate or cancel the contract.Next day delivery applies to working days ( Monday to Friday ) for orders placed before 1pm that are in stock and available for despatch.
   
2. Risk of loss and damage of products passes to you on the date when the goods are delivered.

Payment

1. We take payment at the time we receive your order, once stock availability has been confirmed. Goods are subject to availability. In the event that we are unable to supply you the goods, you will be informed as soon as possible. A full refund will be issued in such cases.
   
2. While we try to ensure that all prices on our website are correct, errors can occur. If an error in the price of goods you have ordered is found, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it and issuing a full refund.
   
3. Title to all goods ordered on this website shall pass to you on delivery, provided that payment has been processed and received in full.

Returns, Cancellations

1. We offer a full money back guarantee in the unlikely event that you receive faulty or damaged goods.
   
2. Any returns or cancellations after an order has been processed will incur a minimum 30% charge plus any courier fees payable.
3. Wheel and tyre packages and special order alloy wheels are non refundable.

Intellectual Property

1. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available to you on this website shall remain at all times vested in SMH Cars Limited or our licensors. You acknowledge and agree that the material and content contained within this website is made available for the sole purpose of your personal non-commercial use. You further acknowledge that any other use of said material and content of this website is strictly prohibited. You further agree not to and agree not to assist or facilitate any third party to reproduce, copy, transmit, publish, display, commercially exploit or create derivative works of such material and content.

Liability and Indemnity

1. Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
   SMH Cars Limited will use reasonable endeavours to verify the accuracy of all information on this website. It does not however make any representation or warranty of any kind implied or expressed, statutory or otherwise regarding the content of information contained on this website. SMH Cars Limited aggregate liability whether in tort, contract or otherwise for loss or damage shall in any event be limited to a sum equal to but not exceeding the amount paid or payable by you for the goods in question.

Miscellaneous Provisions

1. The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
   
2. We have selected our products on the basis that they will be used for domestic use only.
   
3. SMH Cars Limited shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation specified if wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
   
4. Buying wheels which are a different size than originally fitted to the vehicle are purchased entirely at the buyer's own risk. If you are unsure how to calculate the difference between your original wheels and the new set, please contact us.
   
5. All pictures on this website are provided by the manufacturers and are for illustration purposes, meant as an indication to style only.
   
6. Unless stated, tyre brands are subject to change depending on current stock availability. All tyres are fitted based on the speed and load rating requirement of the vehicle as recommended by the alloy wheel manufacturers.
